Colorado's SB 26-189 isn't even in effect yet, and its enforcement timeline is still unsettled. That's exactly why we didn't wait: Whippy's AI recruiter is already independently and continuously audited against it. If it's on your compliance checklist, here's what that testing covers today and where to see the current results.
The Law Behind the Question
Colorado Senate Bill 26-189 establishes a statutory framework governing automated decision-making technology (ADMT) that materially influences consequential decisions, including employment decisions like hiring, promotion, and compensation. Signed into law in May 2026, it replaces Colorado's original 2024 AI law, which never took effect after facing sustained pushback, and takes effect January 1, 2027.
The revised law is narrower than its predecessor. It no longer requires employers to conduct proactive annual impact assessments or maintain a formal risk-management program. What it does keep intact is the underlying exposure: discriminatory outcomes from AI-driven employment decisions remain enforceable under Colorado's existing anti-discrimination law. Removing the impact-assessment mandate changed the paperwork requirement, not the underlying risk.
We're testing against SB 26-189 more than a year before it takes effect, and while the law's implementation timeline faces additional uncertainty: a pending lawsuit from xAI and the U.S. Department of Justice challenges the law's constitutionality, and the state is still finalizing enforcement rules. We'd rather have documented, ongoing evidence in place before a law requires it than scramble to produce it once it does, or once the legal picture settles.
How Whippy Is Audited Against It
The testing itself doesn't change because a law isn't in effect yet: Warden AI, operating independently of Whippy's product team, runs the same two-method audit it runs everywhere else. Disparate impact analysis compares selection and scoring rates across demographic groups; counterfactual analysis checks whether changing a single protected characteristic alone shifts the outcome for an otherwise identical candidate. See Whippy AI Recruiter: Independent Bias Audit Results for the full breakdown.
Warden's audit for Whippy assesses characteristics relevant to Colorado's anti-discrimination framework, including sex, race/ethnicity, age, disability, religion, sexual orientation, national origin, and pregnancy status, among others. For the exact characteristics covered in the current audit cycle, the live report is the source of truth, not this page.
What This Gives You, Precisely
Two testing methods, not one, back this up: group-level disparate impact analysis and individual-level counterfactual testing, both run against the demographic categories Colorado's anti-discrimination framework is concerned with. That combination is what makes this independent, ongoing evidence, not a one-off claim.
An audit report reflects system behavior under tested conditions at a point in time. It isn't a legal certification, and it doesn't guarantee outcomes for your specific deployment or hiring decisions, in Colorado or anywhere else. What it does give you is documented, current evidence you can bring into your own risk review well ahead of SB 26-189's effective date, rather than scrambling to produce it once the date arrives.

Warden re-runs this audit on a recurring basis, so what you'll find isn't a static result from months ago, it's current. Review the full Colorado-specific report, methodology, and latest findings across all tested categories on Warden's public dashboard, hosted independently of Whippy.
