The Law Behind the Question

Illinois House Bill 3773 amends the Illinois Human Rights Act (IHRA) to address employers' use of AI in employment decisions. Effective January 1, 2026, it makes it a civil rights violation for an employer to use AI that has the effect of discriminating against employees or applicants on the basis of a protected class, whether or not that discrimination was intentional. It also requires employers to notify employees and applicants when AI is being used in covered employment decisions, such as recruitment, hiring, and promotion.

One provision is worth calling out specifically: HB 3773 explicitly prohibits using zip codes as a proxy for protected classes, a provision the other state laws we test against don't call out by name. Zip code is a well-documented workaround for indirectly encoding race, national origin, or socioeconomic status into a model.

Like California and Colorado, Illinois doesn't mandate a specific bias-testing methodology. The exposure comes from outcomes, not paperwork: because liability turns on discriminatory effect rather than intent, documented testing is the practical way to catch a problem before it becomes a violation.
