The Law Behind the Question
The EU AI Act (Regulation 2024/1689) sorts AI systems into three tiers of scrutiny, prohibited, high-risk, and lower-risk, based on the potential for harm. Recruitment tools sit in the high-risk tier, which carries obligations around risk management, pre-market testing, post-market monitoring, transparency, and human oversight.
Timing has shifted since the Act was first adopted. High-risk obligations for tools like recruitment AI were originally set to apply from August 2, 2026. In July 2026, the EU formally adopted the "Digital Omnibus on AI," deferring that deadline to December 2, 2027, a 16-month delay driven largely by the practical challenges of standing up the testing, documentation, and third-party assessment infrastructure the Act requires.
That deferral doesn't reduce the underlying obligation, it postpones it. Once the high-risk provisions apply, an EU AI Act-covered recruitment tool will need to demonstrate exactly the kind of independent, ongoing bias testing described below. We're not waiting for the deadline to get there.
